By accessing or using the NinePocket application and website (the "Service"), operated by TPS Worldwide LLC ("we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.
NinePocket is a mobile application that provides trading card scanning, identification, and pricing data services. The Service uses camera-based scanning technology and artificial intelligence to identify trading cards from photographs and provide estimated market values based on recent sold comparable listings.
You must create an account to use NinePocket's scanning features. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must be at least 13 years of age to use the Service.
NinePocket operates on a credit-based model. Scanning cards consumes credits. Some free credits may be included with your account. Additional credits may be purchased through the Service. Credit pricing, allotments, and expiration policies are subject to change at our discretion.
By using NinePocket, you grant TPS Worldwide LLC a non-exclusive, worldwide, royalty-free license to use, store, process, and analyze images and data submitted through the Service, including for the purposes of improving our technology, training machine learning models, and developing new features. Submitted images may be stored indefinitely even after account deletion.
Pricing data provided by NinePocket is for informational purposes only. Prices are estimates based on recent sold comparable listings and are not guaranteed. NinePocket is not responsible for buying or selling decisions made based on this data. Market values fluctuate and actual sale prices may differ significantly from estimates shown in the Service.
You agree not to: (a) use the Service for any unlawful purpose; (b) attempt to reverse-engineer, decompile, or disassemble the Service; (c) interfere with or disrupt the Service or servers; (d) upload malicious content; (e) use automated tools to access the Service beyond normal usage; or (f) resell or redistribute data obtained from the Service without authorization.
The Service, including all content, features, and functionality, is owned by TPS Worldwide LLC and is protected by copyright, trademark, and other intellectual property laws. You retain ownership of images you submit but grant us the license described in Section 5.
You agree to indemnify, defend, and hold harmless TPS Worldwide LLC, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in connection with your use of the Service, violation of these Terms, or infringement of any third-party rights.
Any dispute arising from or relating to these Terms or the Service shall be resolved through binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. You agree to waive your right to participate in class actions, class arbitrations, or representative proceedings. You have 30 days from the date you first use the Service to opt out of this arbitration provision by sending written notice to ninepocketapp@gmail.com.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. TPS WORLDWIDE LLC DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY DEFECTS WILL BE CORRECTED. USE OF THE SERVICE IS AT YOUR SOLE RISK.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, TPS WORLDWIDE LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE LESSER OF (A) THE TOTAL AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100).
We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time, with or without notice. We may update these Terms from time to time. Continued use of the Service after changes constitutes acceptance of the updated Terms. We may terminate your account at our sole discretion for any reason.
These Terms shall be governed by and construed in accordance with the laws of the State of Arizona, without regard to its conflict of law provisions. Any legal proceedings not subject to arbitration shall be brought in the state or federal courts located in Arizona.
